It is important for both of us that you understand our contractual relationship relating to the booking of a short break or holiday. When you make a holiday reservation with us (whether via our website, by email, telephone or post), these conditions are deemed to have been accepted by you.

HOLIDAY CONFIRMATION AND PAYMENT

A holiday confirmation form will be issued to you upon receipt by Old Tavistock Railway Station of a completed holiday booking form, together with a deposit or full payment. For weekly bookings 25% of the total rental charge per week, per house is payable immediately. Short breaks should be paid in full on booking.

Any balance should be paid to Old Tavistock Railway Station eight weeks prior to the commencement of the holiday (the due date will be stated in the holiday confirmation form sent to you).

If Old Tavistock Railway Station has not received the balance by the due date, an overdue reminder letter or email will be issued. If the balance is still not received, Old Tavistock Railway Station reserves the right to cancel the holiday booking and your deposit will be forfeited. You will have no claim against Old Tavistock Railway Station for compensation or reimbursement whatsoever.

All bookings received by Old Tavistock Railway Station for holidays due to commence within eight weeks must be accompanied by full payment.

Prices stated are on a per house and per short break or per week basis.

The prices stated on the website and in our marketing literature are the full cash prices. We DO NOT charge booking fees or charge for payments made by credit or debit card. However, any charges raised against Old Tavistock Railway Station by its bank for handling dishonoured cheques, bank transfers or any other payments, must be reimbursed by you to Old Tavistock Railway Station within seven days of Old Tavistock Railway Station’s request to do so.

All payments must be made in pounds sterling.

You undertake to us that the details you give to us while making a booking are correct, in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the holiday.

We DO NOT make any additional charge for gas or electricity. We do request that guests are considerate in their use of electricity and gas in our efforts to help preserve the environment.

Old Tavistock Railway Station reserves the right to refuse any booking.

Old Tavistock Railway Station reserves the right to correct any error in both advertised and confirmed prices.

Whilst every effort has been made to ensure accuracy and availability, some errors might still occur. Once aware of such incidents we will make all reasonable effort to advise you within 48 business hours of the booking being made. We reserve the right to cancel the reservation and refund all monies paid, but this of course will be without any liability to you.

CHANGES BY THE HOLIDAYMAKER

Immediately upon receipt of the holiday confirmation from Old Tavistock Railway Station, you should check the details and notify Old Tavistock Railway Station immediately of any correction required as soon as possible. Old Tavistock Railway Station reserves the right to charge a holiday booking amendment fee to administer/correct any error made by you.

CANCELLATION BY HOLIDAYMAKER

You, the holidaymaker should notify Old Tavistock Railway Station immediately and in writing of any intention to cancel the holiday booking. The cancellation only takes effect when Old Tavistock Railway Station has received written confirmation from you.

If Old Tavistock Railway Station is unable to re-let the holiday accommodation for the period of the cancelled holiday, all monies paid by you to Old Tavistock Railway Station shall be forfeited to Old Tavistock Railway Station.

If the holiday accommodation is re-let, monies received by Old Tavistock Railway Station for the re-let holiday, may be refunded to you within 2 weeks after the re-let holiday has been paid for in full, less any costs incurred by Old Tavistock Railway Station to re-advertise the cancelled week/weeks.

No refunds will be given for cancelled short breaks, whether or not the holiday accommodation is re-let.

Holiday cancellation insurance is not provided by Old Tavistock Railway Station and is not included in the price of the holiday. All holidaymakers are recommended to take independent advice on appropriate holiday insurance.

 

CANCELLATION OR CHANGES BY OLD TAVISTOCK RAILWAY STATION

In the unlikely event of Old Tavistock Railway Station being unable to arrange the holiday accommodation requested by you, or if the property booked by you becomes unavailable for whatever reason, Old Tavistock Railway Station will endeavour to arrange alternative accommodation for you, of an equivalent type and standard in a similar location, failing which (or on your request) all monies paid by you will be refunded. Old Tavistock Railway Station will then have no further liability to you in that respect.

Old Tavistock Railway Station is not liable for any additional cost of any alternative accommodation, which must be paid by you.

If the offer of alternative accommodation is not accepted by you within 28 days, a refund of all monies paid will be given by Old Tavistock Railway Station.

 

WEBSITE & MARKETING LITERATURE

Whilst to the best of Old Tavistock Railway Station’s knowledge the details relating to any property described on Old Tavistock Railway Station’s website and in marketing literature were correct at the time of publication. Old Tavistock Railway Station reserves the right to make alterations to the website and marketing literature at any time and shall endeavour to inform you of any such alterations. Old Tavistock Railway Station cannot accept responsibility for any changes or closures to area amenities or attractions mentioned on the website and in marketing literature.

Old Tavistock Railway Station does not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties

RESPONSIBILITIES OF THE HOLIDAYMAKER

During the period of the holiday, you undertake the following:

That the number of people occupying the property will not exceed the number stated on the booking form. If it does the property owner/caretaker can refuse to allow you to take possession of the property or make you leave the accommodation before the end of the holiday. If this happens Old Tavistock Railway Station shall treat the holiday as being cancelled by you and you will have no claim against Old Tavistock Railway Station for compensation or reimbursement whatsoever. You therefore agree:

That the Property will be used solely for the purpose of a holiday by you and your party.

To show due consideration for other parties. If you abuse the property or display dangerous, offensive or rude behaviour to the property owner/caretaker or any third parties (e.g. neighbours), the property owner/ caretaker has the right to ask you to leave the accommodation before the end of the holiday. If this happens Old Tavistock Railway Station shall treat the holiday as being cancelled by you and you will have no claim against Old Tavistock Railway Station for compensation or reimbursement whatsoever.

To keep noise to a minimum after 11pm and before 7am.

Respect our neighbours by vacating the Station platform by 11pm.

Keep the bike wash down area clean, ready for the next guest to use.

To allow the property owner or his representatives access to the property at any reasonable time during the period of the holiday.

To keep the property and all furniture, utensils, equipment, fixtures and fittings in or on the property in the same state of repair and condition as at the commencement of the holiday and to ensure that at the end of the holiday the property is left in the same state of order and cleanliness in which it was found. The property owner reserves the right to levy an additional charge for any extra cleaning required after your occupancy and for any consequential loss. Any damages incurred will be deducted from your credit card.

To report as soon as possible to the property owner any breakages or damage caused by you during the holiday and to reimburse the property owner with the cost of replacement. The property owner reserves the right to make a claim against you for repair or loss as a result of damage caused; via your credit card.

To notify all other members of your party of these conditions;

To arrive after 3p.m. on the arrival day and to vacate the property by 10a.m. on the day of departure unless prior arrangement has been agreed with the property owner.

Your vehicles, their contents and your personal belongings are left at the property during (prior to and after) the period of the holiday entirely at your own risk.

You must not (without the express permission of the property owner) allow any person other than guests booked and staying in the property for their holiday to use the facilities and amenities of the property.

LIABILITY

During the period of the holiday, you undertake and agree to the following:

Old Tavistock Railway Station shall accept no liability to you for any loss, damage or injury howsoever caused to you or to your personal property (or to persons in your party or their personal property) during your stay at the property except to the extent such loss, damage or injury is caused by the negligence or wilful default of Old Tavistock Railway Station.

Old Tavistock Railway Station gives no warranty and is not responsible for the accuracy or otherwise of any information or representations given verbally by its servants or agents.

COMMUNICATION AND INFORMATION

During the period of the holiday, you undertake the following:

For the purpose of the Data Protection Act, all personal and other information and details collected by Old Tavistock Railway Station in the course of its business, belongs to Old Tavistock Railway Station and will not be disclosed — except as necessary to the property owner/caretaker when confirmation of holidays booked at a property is given.

We won’t send you e-mails which you do not want. Please advise us at the time of booking if you would like to be excluded from any Station newsletters or other marketing materials.

COMPLAINTS

In the unlikely event you have cause for dissatisfaction, make this known to the property owner (or caretaker for the property) as soon as possible.

PETS

Guide, Hearing and Assistance dogs are welcome at Old Tavistock Railway Station. Unfortunately we are unable to accommodate pets.

SMOKING

For the comfort of all our guests, smoking is not allowed in any of the areas known as Old Tavistock Railway Station, this includes the outside and communal spaces.

CONTRACT

All contractual obligations arising out of these conditions shall be subject to English Law and the exclusive jurisdiction of the English Courts.

Please make sure that you have read and understood these terms and conditions, it is your responsibility to make sure you have done so.

Unless we have your express consent we will only disclose personal data to third parties if this is required for the purpose of completing your transaction with us. This is of course subject to the proviso that we may disclose your data to certain permitted third parties, such as members of our own group, our own professional advisers who are bound by confidentiality codes, and when we are legally obliged to disclose your data.
